The liability is governed by Article 6:162 Civil Code, which stipulates that you want liable if:

• There is a tort. That is, if you violate a law of another, or in conflict with a legal obligation or social care act. Furthermore, it is also liable for the wrongful acts of others. Think of the liability for parents and their children. This is called strict liability.
• The fault can be attributed to the perpetrator.
• Actually being injured.
• There is a causal connection between the accident and injury.
